By creating an account, placing an order, or using XenBite, you agree to these Terms.

1. About XenBite

XenBite is a technology platform that connects users with participating food vendors offering fresh food and surplus food deals for collection.

XenBite primarily operates as a click-and-collect marketplace and is not the producer, preparer, or seller of food items listed by vendors.

2. User Eligibility

Users must provide accurate information when creating an account.

Users are responsible for maintaining the confidentiality of their account credentials.

XenBite reserves the right to suspend accounts involved in fraud, abuse, misuse, or violations of these Terms.

3. Ordering & Collection

Orders placed through XenBite must be collected within the collection window provided by the vendor.

Users are responsible for arriving on time for collection.

Vendors may dispose of uncollected food after the collection period has expired.

4. Refund & Cancellation Policy

Users may cancel an order within 10 minutes of placing it only if the Vendor has not yet accepted the order.

Once a Vendor accepts the order, cancellation may no longer be available.

Failure to collect an order within the collection window may result in no refund being issued.

Refund decisions may vary depending on the circumstances, payment provider requirements, or applicable consumer protection laws.

XenBite reserves the right to investigate refund abuse or suspicious activity.

5. Food Quality & Vendor Responsibility

All food preparation, hygiene, storage, packaging, ingredients, and food safety responsibilities belong solely to the Vendor.

Any food-related issues, including but not limited to:

  • Food quality concerns
  • Allergic reactions
  • Incorrect ingredients
  • Contamination
  • Food poisoning
  • Expired or spoiled items

shall be the responsibility of the Vendor and not XenBite.

XenBite acts solely as a technology platform facilitating transactions between users and Vendors.

6. Allergy & Dietary Information

Users are responsible for reviewing ingredient and allergen information before purchasing food items.

Vendors are responsible for providing accurate allergen information.

XenBite does not guarantee that food items are free from allergens or cross-contamination risks.

7. Surplus Food Purchases

Surplus food items are discounted products intended to reduce food waste.

Surplus items may vary in appearance, availability, preparation time, or packaging compared to regular menu items.

By purchasing surplus food, users acknowledge and accept these differences provided the food remains safe for consumption.

8. Payments

Payments may be processed by third-party payment providers such as Stripe or other authorized payment processors.

XenBite is not responsible for delays, banking issues, or payment processor disruptions beyond its control.

9. Promotions, Rewards & Credits

XenBite may offer rewards, referral bonuses, streak rewards, discounts, or promotional credits from time to time.

Promotions may be modified, suspended, or withdrawn at any time without prior notice.

Promotional rewards may be subject to expiration dates, eligibility rules, and abuse prevention systems.

10. User Conduct

Users agree not to:

  • Abuse vendors or staff
  • Engage in fraudulent activity
  • Abuse refund systems
  • Use fake accounts
  • Manipulate promotions or referral systems
  • Attempt unauthorized access to the platform
  • Interfere with platform operations

XenBite reserves the right to suspend or terminate accounts involved in prohibited activities.

11. Platform Availability

XenBite does not guarantee uninterrupted access to the platform.

Temporary downtime, maintenance, updates, or technical issues may occasionally occur.

XenBite reserves the right to modify or discontinue platform features at any time.

12. Limitation of Liability

To the maximum extent permitted by law:

  • XenBite shall not be liable for indirect, incidental, or consequential damages arising from the use of the platform.
  • XenBite is not responsible for food quality, food safety, preparation issues, vendor conduct, collection delays, or disputes between users and vendors.
  • XenBite’s role is limited to providing the technology platform facilitating orders.

13. Privacy & Data Protection

User information will be handled in accordance with applicable privacy and data protection laws, including UK GDPR where applicable.

XenBite may collect and process information necessary to operate the platform and fulfill orders.

Users agree not to misuse vendor or platform information obtained through the service.

14. Account Termination

Users may request account deletion by contacting XenBite support.

XenBite reserves the right to suspend or terminate accounts that violate these Terms or engage in harmful activity.

15. Force Majeure

XenBite shall not be held responsible for delays or failures caused by events beyond reasonable control, including:

  • Internet outages
  • Power failures
  • Natural disasters
  • Government actions
  • Cyberattacks
  • Third-party service disruptions

16. Changes to Terms

XenBite reserves the right to update or modify these Terms at any time.

Continued use of the platform after updates constitutes acceptance of the revised Terms.

17. Governing Law

These Terms shall be governed by the laws of England and Wales.

Any disputes shall be subject to the jurisdiction of the courts of England and Wales.
